TERMS & CONDITIONS

KAI YORK WORKSHOPS / TERMS & CONDITIONS AGREEMENT

These terms and conditions form the agreement between you and Kai York Workshops and as such are a direct part of the respective contractual relationship between Kai York and the individual participants. By booking a workshop you sign into this agreement and agree to abide and be bound by these terms and conditions.

I. Kai York Workshops

1.1 All participants, Kai York and especially the models, must be treated respectfully at anytime prior, during and after all Kai York workshops. Kai York remains the right to ask any participant to leave the workshop if behavior or conduct is deemed unacceptable or inappropriate. No refund of fees will be made.

1.2 Kai York is entitled to make changes to the structure of the workshop due to unforeseen circumstances. In the unlikely event that changes are made, there will be notice made to all attendees as soon as possible.

1.3 Participation as well as arrival and departure are - unless otherwise expressly agreed between the individual parties - at your own expense. Necessary expenses will not be reimbursed.

1.4 Every participant must arrive at the event location on time at the start of the event. Late arrivals may not be granted entry if the event has already started.

1.5 The instructions of Kai York or its vicarious agents (officials) must be followed unconditionally for the entire duration of the event.

II. Fees & Cancellations

2.1 The workshop fee must be paid in full at the time of your purchase. The fee is not refundable.

2.2 Kai York may cancel a workshop at any time prior to commencement. In the unlikely event that we cancel a workshop you will be notified as soon as possible and any fees or deposits received from you will be refunded. Please note that Kai York will not refund travel or accommodation costs for cancelled workshops.

III. Image Usage & Privacy

3.1 Attendees are NOT permitted to use images taken at the workshop for commercial third-party purposes. Image usage is strictly portfolio use only (website and online). Social media usage is allowed but only to showcase your portfolio and must be marked as product of the Kai York workshop. Images must not be submitted to magazines, exhibitions or competitions without permission of the model.

3.2 Images take must NOT be used for any adult entertainment purposes or third-party use of the adult entertainment industry unless explicitly otherwise agreed upon in writing.

3.3 You acknowledge that we have advised you that none of the participants in the workshop have given releases allowing commercial use of any images taken at the workshop and that you may be subject to legal liability if you use any images commercially beyond your own portfolio. You agree to indemnify and defend Kai York, its members officers and employees and all other participants in the workshop from any claims, losses, costs or expenses (including attorneys’ fees and disbursements) arising out of or relating to any claim that you have used an image taken at the workshop in any manner that is not permitted in this Agreement.

3.4 If you are unsure about what is a permitted usage, please contact Kai York for confirmation; provided that, you shall not be relieved of any obligations under paragraph 3.3, above.

3.5 Attendees must credit ‚Kai York Workshops’ when posting images on social media.

3.6 The models each receive the irrevocable right to use the images provided to them on a voluntary basis by the photographer for self-promotional purposes (sedcard, homepage, model portfolio) for an unlimited period of time.

3.7 If other participants than the model can be seen in photos, it must be ensured that images may not be published or distributed without the consent of all people depicted in them.

3.8 The participants agree that Kai York will, at its own discretion, have video and/or photo material made of the workshop as such, in which the participants will also be visible.

3.9 Each participant allows Kai York to use the images and film material created for documentation and self-promotion purposes on the Internet or in other media. The consent is irrevocable and is generally valid for an unlimited period. However, it only applies if the publication does not violate any legitimate interest of the person depicted, such as the depiction in a distorting or compromising manner.

IV. Liability

4.1 Participants herby waive any responsibility of Kai York for any personal injury or damage to property from incidents occurring at the workshop or the workshop venue or for damage suffered by participants on arrival or departure.

4.2 Kai York is not responsible for loss or damage of your personal property.

4.3 Kai York is not liable for unauthorized publication, distribution or other copyright infringements committed by individual participants or through photos taken by them during photo shoots or otherwise to the detriment of other participants.

V. Cancellation

5.1 If the event is canceled (due to illness of Kai York or under-occupancy of the workshop), participants will receive an immediate refund of the participation fees paid. The participant has no right to further reimbursement.
